Discipline and Misconduct

The David Kennedy & Associates team provides assistance with disciplinary responses to Investigator’s Reports, and review proceedings filed under section 174 and section 181E of the Police Act 1990.  We can assist Probationary Constables with their submissions, in relation to proposed dismissals under section 80 of the Police Act 1990.

David Kennedy & Associates can assist with submissions and responses to other show cause notice, transfers and mobility, promotions, and secondary employment applications.  We also provide advice and representation in relation to non-reviewable decisions, and those under Schedule 1 to the Police Act 1990.

Personal Injury

We can progress injury claims under the Workers Compensation Act 1987, the Workplace Injury Management and Workers Compensation Act 1990, and the Police Regulation (Superannuation) Act 1906.  We have a working knowledge of NSWPF policies, procedure, and dispute and review processes.

We have provided advice and representation to current and former police officers in relation to their rights and prospects of success in relation to:

  • Entitlements under the Police Superannuation Scheme, pre ’88 pensions, lump sums, top ups, sections 10B (1) & (2), and section 12D applications under the Police Regulation (Superannuation) Act 1906;

  • SASS Scheme, and post 88 superannuation schemes and entitlements;

  • TPD claims in relation to Metlife, TAL, and Police Blue Ribbon policies; 

  • Medical discharges and section 94B queries and disputes;

  • Return to Work Plans, suitable duties, and transition procedures;

  • Compensable workplace injuries, and compensation under sections 66 & 67 Workers Compensation Act 1987;

  • Optional disengagement eligibility and procedures;

  • Remuneration, duties, and entitlements under the Crown Employees (Police Officers) Award as amended from time to time; and

  • Disputes, claims and relief available to current and former police officers, including common law negligence claims.
